5. Your art stays yours - Ownership transfers do not affect your copyright or ownership of your work
This policy is a binding condition on any future sale or transfer of SuprSketch.

Welcome to SuprSketch! These Terms of Service ("Terms") govern your use of our platform. By accessing or using SuprSketch, you agree to these Terms.
If you don't agree, please don't use our Services.
SuprSketch exists to support and protect human artists. We're building a community where creativity thrives, artists are respected, and human-made art is celebrated and preserved.
What makes us different:
• We will never sell your data or artwork
• We prioritize artist rights and creative control
• We're committed to transparency and fairness
• We protect human creativity in the age of AI
To keep things clear, here's what we mean by:
• "Platform" - SuprSketch's website, streaming services, applications, and tools
• "Artist" - Users who create and stream content
• "Subscriber" - Users who pay for access to Artist content
• "Content" - Artwork, streams, videos, and materials created or shared on the Platform
• "Moderator" - Individuals designated to help enforce community standards
• "Services" - All features, tools, and functionality we provide
To use SuprSketch, you must:
• Be at least 18 years old
• Provide accurate information - Keep your details current
• Secure your account - Choose a strong password and keep it private
• Use one account - No multiple accounts to evade restrictions
• Notify us of breaches - Tell us immediately if your account is compromised
• General User Accounts - Browse and interact with public content
• Artist Accounts - Create, upload, and stream content
• Subscriber Accounts - Access paid content and support artists
We strive to be fair and transparent with account management. That said, we need flexibility to protect the community and platform integrity.
We may modify, suspend, or terminate accounts when:
• Terms are violated - Breaking rules or policies
• Harmful behavior occurs - Harassment, abuse, or illegal activity
• Platform security is threatened - Hacking attempts, exploits
• Payment issues arise - Chargebacks, fraud
• Legal requirements demand it - Court orders, law enforcement
We'll usually provide warning and explanation, except when:

• You can leave anytime - Take your content with you
By uploading content, you grant SuprSketch a limited license to:
• Store your content - On our servers
• Display your content - To users you authorize
• Stream your content - Through our platform
• Maintain platform integrity - Cache, format for different devices
This license:
• Is non-exclusive (you can use your art anywhere)
• Lasts only while you're on the platform
• Ends when you delete content or your account
• Is limited to operating the platform (we won't use it for other purposes)
As a subscriber, you get:
• Viewing access - Watch content during your subscription
• Personal enjoyment - For your own use only
You do NOT get:
• Download rights (unless artist explicitly allows)
• Recording rights
• Distribution rights
• Ownership or licensing rights
We will:
• Protect artist content - From unauthorized use
• Enforce copyright - Help artists protect their work
• Never release content without permission - Artists control their work
• Respect takedown requests - Artists can remove content anytime
We will not use, share, or distribute artist content for any purpose other than operating the platform as artists intend.
• All payments through Stripe - Industry-leading secure payment processing
• We don't store card details - Stripe handles all sensitive payment data
• Automatic billing - Subscriptions renew automatically unless cancelled
How it works:
• You'll be charged at the start of each billing period
• Subscriptions auto-renew for the same duration (monthly/yearly)
• You maintain access through the paid period
• Access ends when subscription expires or is cancelled
Cancellation:
• Cancel anytime through your account settings
• Contact support if you need help cancelling
• Access continues until the end of your current billing period
• No partial refunds for unused time
We generally don't offer refunds for subscription payments because:
• Digital content is immediately accessible
• Artists rely on subscriber support
• Subscriptions are month-to-month or annual commitments
However, we'll consider refunds for:
• Billing errors - If you were incorrectly charged
• Technical issues on our end - If our platform failure prevented access
• Fraudulent charges - Unauthorized use of your payment method
To request a refund, email support@suprsketch.com within 7 days with details.
Artists receive payouts according to their agreements with SuprSketch. Payment terms, revenue splits, and payout schedules are detailed in separate Artist agreements.
While you own your artwork, SuprSketch Corp. owns all rights to the platform itself, including:
• Platform Code & Software - All source code, algorithms, and technical infrastructure
• Design & Interface - Visual design, layout, user interface, and user experience
• Streaming Technology - Our proprietary streaming systems and delivery methods
• Applications & Plugins - Desktop app, Photoshop plugin, and all related software
• Trademarks & Branding - SuprSketch name, logos, and brand assets
• Documentation & Materials - User guides, API documentation, and support materials
• Data & Analytics - Platform metrics, aggregated data, and operational insights
You are prohibited from:
• Copying or reproducing - Our platform code, design, or functionality
• Reverse engineering - Attempting to decompile, disassemble, or extract our source code
• Creating derivative works - Building competing platforms based on SuprSketch
• Scraping or data mining - Automated extraction of platform data or content
• Circumventing protections - Breaking or bypassing technical security measures
• Removing attributions - Deleting copyright notices or branding
• Misusing APIs - Using our APIs beyond their intended purpose or without authorization
• Unauthorized commercial use - Reselling, licensing, or distributing our technology
We grant you a limited, non-exclusive, non-transferable, revocable license to:
• Access and use the SuprSketch platform for its intended purpose
• Use our applications and plugins as provided
• View and interact with content according to these Terms
This license does NOT give you:
• Ownership of any platform technology
• Rights to modify or redistribute our software
• Permission to create competing services
• Access to our source code or proprietary systems
We take protection of our platform seriously. Violations of our intellectual property rights may result in:
• Immediate account termination
• Legal action for damages
• Injunctive relief to stop unauthorized use
• Reporting to law enforcement if criminal activity is involved
While SuprSketch's platform is proprietary, we may use open-source components that are subject to their own licenses. The use of such components does not grant you any additional rights to our proprietary code or systems.

• Your art is yours - We will never claim ownership of your creative work
• Our platform is ours - You cannot claim ownership of our technology

SuprSketch is a community of artists and art lovers. We want everyone to feel safe, respected, and inspired.
You may not:
Content Violations:
• Post illegal content or content that violates others' rights
• Share content depicting or promoting violence or harm
• Upload malware, viruses, or malicious code
• Post spam or misleading information
• Infringe on copyrights or trademarks
Behavioral Violations:
• Harass, bully, or threaten other users
• Discriminate based on race, gender, religion, orientation, etc.
• Impersonate others or create fake accounts
• Coordinate targeted attacks or harassment
Technical Violations:
• Record or download content without permission
• Share account credentials or access
• Circumvent security measures or access controls
• Use bots, scripts, or automation without authorization
• Attempt to hack or disrupt the platform
Commercial Violations:
• Engage in unauthorized commercial activities
• Sell or transfer accounts
• Manipulate platform features for unfair advantage
• Advertise or solicit outside the designated areas
These guidelines protect:
• Artists - From theft and harassment
• Subscribers - From scams and bad actors
• The Community - From toxic behavior
• The Platform - From abuse and exploitation
We want to be firm with bad actors but fair to everyone else. Moderation decisions are made thoughtfully, considering context and intent.
We generally follow this framework (though we'll adjust based on circumstances):
Tier 1 - Minor (Warning):
• First-time inappropriate language
• Mild spam or off-topic chat
• Unintentional guideline violations
Typical Action: Warning, temporary chat restriction
Tier 2 - Moderate (Temporary Restriction):
• Repeated minor violations
• Harassment or disruptive behavior
• Excessive self-promotion
• Ignoring moderator requests
Typical Action: Temporary ban (1-7 days), feature restrictions
Tier 3 - Serious (Suspension):
• Continued violations after warnings
• Targeted harassment
• Hate speech
• Attempting to circumvent moderation
• Sharing prohibited content
Typical Action: Suspension (7-30 days), loss of privileges
Tier 4 - Severe (Permanent Ban):
• Repeated serious violations
• Extreme harassment or threats
• Illegal activity
• Copyright violations with proof
• Ban evasion
Typical Action: Permanent account termination, IP ban
Tier 5 - Critical (Immediate Permanent Ban):
• Explicit violent threats
• Criminal activity
• Child safety violations
• Extreme terms violations
• Coordinated attacks on the platform
Typical Action: Immediate permanent ban, possible legal referral
Artist-Appointed Moderators:
• Can moderate their own streams and chats
• Enforce artist-specific rules
• Report issues to SuprSketch staff
SuprSketch Staff:
• Handle platform-wide moderation
• Make final decisions on complex cases
• Can override artist moderator actions when necessary
• Enforce Terms of Service
We commit to:
• Consistency - Treating similar cases similarly
• Transparency - Explaining decisions when possible
• Context - Considering circumstances and intent
• Fairness - Giving users benefit of the doubt when appropriate
However, we reserve final discretion on moderation decisions to protect the community, especially in:
• Urgent safety situations
• Complex or unprecedented cases
• Situations involving legal requirements
We understand mistakes happen and context matters. If you believe a moderation decision was wrong, you can appeal.
Appeal Process:
1. Wait 15 days - Cooling-off period before submitting appeal
2. Submit your appeal - Email support@suprsketch.com with:
• Your username
• The date of the action
• Why you believe the decision was incorrect
• Any evidence supporting your case
3. We review - Typically within 7-14 days
4. Decision is made - We'll explain our reasoning
Appeal Rules:

DMCA Takedown Process:

Organizations with 50+ employees must get prior authorization to use SuprSketch. This includes:
• Enterprise companies
• Educational institutions
• Government agencies
• Large organizations
• Multi-user corporate deployments

• We'll respond within 14 days
Special pricing and terms may apply for institutional use.
Employees of large organizations may maintain personal accounts for non-institutional use, provided:
• It's not part of company business

• It's genuinely personal creative work
We work hard to provide high-quality streaming, but we want to be honest about what affects your experience.
Things outside our control:
• Your internet connection speed and stability
• Artist's internet connection
• Geographic distance from servers
• Device capabilities and browser compatibility
• Network congestion and ISP throttling
Things we control:
• Server capacity and performance
• Content delivery network optimization
• Platform code and efficiency
• Automatic quality adjustment features
We will:
• Invest in infrastructure - Constantly upgrade servers
• Optimize performance - Improve streaming technology
• Communicate issues - Let you know about problems
• Work to resolve problems - Fix bugs and improve experience
We don't guarantee:
• Specific resolution or frame rates
• Uninterrupted service 24/7
• Perfect quality in all conditions
• Compatibility with all devices
Occasional technical issues are inherent to streaming services. We'll always work to fix problems, but we can't promise perfection.
Generally, subscriptions are non-refundable (see Payment section). However, if our platform failure prevents you from accessing content for an extended period, contact support—we'll work with you on a case-by-case basis.
When streaming, artists must:
• Comply with platform policies - In real-time
• Respond to violations - Address issues when notified
• Monitor their chat - Or appoint moderators to help
We may:
• Monitor streams - Spot-check for policy compliance
• End problematic streams - If they violate terms
• Restrict streaming privileges - For repeat violations
• Use automated filtering - To catch obvious violations
We'll typically warn before ending a stream, unless:
• Content is illegal
• Immediate harm is occurring
• Violation is severe and obvious
Chat is for community interaction and should be:
• Respectful
• On-topic
• Positive and supportive
• Safe for all participants
• Artist moderators manage their own chats
• SuprSketch staff handle platform-wide issues
• Automated systems may filter obvious violations
• Chat logs are kept for safety and moderation
Chat access may be restricted for:
• Repeated violations
• Harassment or toxicity
• Spam or disruption
• Ban evasion
Chat restrictions can be temporary or permanent depending on severity.
We may modify these Terms to:
• Reflect new features or changes
• Address legal requirements
• Improve clarity or fairness
• Respond to community feedback
Notification methods:
• Email to registered address
• Prominent website notice
• In-app announcement
Timeline:
• Minor changes - Effective 7 days after notice
• Material changes - Effective 30 days after notice

SuprSketch is provided "as is" and "as available." While we strive for excellence, we can't guarantee:
• Perfect uptime or availability
• Error-free operation
• Specific results or outcomes
• Uninterrupted access
To the extent permitted by law:
• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We're not responsible for third-party actions or content
This doesn't limit liability for:
• Death or personal injury from our negligence
• Fraud or fraudulent misrepresentation
• Anything that can't be limited by law
You're responsible for:
• Your own content and actions
• Backing up your own data
• Your internet connection and device
• Compliance with applicable laws
These Terms, along with our Privacy Policy, constitute the entire agreement between you and SuprSketch.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. SuprSketch Corp. is a Delaware corporation with principal offices in Anchorage, Alaska.
We encourage resolving disputes informally first. Contact us and we'll try to work it out.
If that doesn't work:
• Small claims court is available for eligible disputes
• Both parties waive jury trial rights
• Disputes will be resolved individually (no class actions)
If any provision of these Terms is found unenforceable, the rest remains in effect.
Our failure to enforce any right or provision doesn't waive that right.
You can't transfer these Terms or your account. We may transfer our rights and obligations to another entity, subject to our data protection guarantees.
